On the same day Minṭāsh summoned again the caliph al-Mutawakkil ʿalā Allāh, the judges, and the learned men, to take up the question of a legal decision regarding al-malik al-Ẓāhir and a declaration of war against him. Nāṣir al-Dīn al-Ṣāliḥī, documentary secretary of the judiciary, drafted a decision concerning al-Ẓāhir, presenting the case of one who had deposed the caliph and the sultan; who had killed a descendant of the Prophet in the sacred month of al-Muḥarram and in the sacred city despite the fact that he was sacrosanct (the reference was to ʾAḥmad ibn ʿAjlān, ruler of Mecca); who had unlawfully appropriated men’s property; who was guilty of murder; and various other charges. Ten copies of the document were made, and a number of notables and judges signed.
